Autobytel sues InsWeb for patent infringementShares of InsWeb Corp. (Nasdaq: INSW) are in negative territory on news before the start of trading that the insurance information website is being sued by Autobytel Inc. (Nasdaq: ABTL) for patent infringement. Irvine, Calif.-based Autobytel, a small-cap automotive marketing services company, has filed a lawsuit in the U.S. District Court for the Eastern District of Texas against micro-cap InsWeb, according to news reports. Autobytel is seeking damages and wants a permanent injunction. Gold River, Calif.-based InsWeb said it was surprised to hear of the lawsuit and is convinced it is not guilty of any wrongdoing. Shares of InsWeb (INSW) were down 14.18%, or $1.53, at $9.26 at today’s closing.

Russell lags as Dow nears record
April 17 (SmallCapInvestor.com) – The Dow almost set a new closing record high today following news of low core inflation and stronger-than-expected home construction data. Small caps did not fare as well, with shares of teeth whitening company BSML Inc. (Nasdaq: BSML) falling on news of a possible delisting, while InsWeb Corporation’s (Nasdaq: INSW) doubled its stock price after reporting its first ever profit.

The Russell 2000 failed to improve after Monday’s record close, losing 2.48 points, or 0.30 percent, to 828.96. The Dow Jones Industrial Average was unable to set a new closing record despite adding 52.58 points, or 0.41 percent, to 12,773.04. The record is 12,786.64, set on Feb.20.

InsWeb posts first-ever profitInsWeb Corp. (Nasdaq: INSW) announced after-hours Monday that it turned the corner to profitability for the first time. For the first quarter ended March 31, the Gold River, Calif.-based online insurer posted net income of $400,000, or $0.10 per share, on revenue of $8.1 million, versus a net loss of $1.7 million, or $0.41 per share, on revenue of $7.7 million in the prior year period.
Monday after hours
Shares of Netlist Inc. (Nasdaq: NLST) fell $0.86, or 14.4%, to $5.11 in after-hours trading Monday after the memory subsystems manufacturer issued a lower-than-expected revised first-quarter guidance. Irvine, Calif.-based Netlist said it now expects to report earnings per share of $0.02 to $0.03 per share on revenue of $37 million to $38 million. The firm had previously issued guidance of $0.07 to $0.08 per share on revenue of $40 million to $42 million. Three analysts polled by Thomson First Call were expecting earnings per share of $0.08 on revenue of $41.2 million for the quarter ended March 31. Netlist CEO Chuck Hong cited operating expenses and decreased customer demand for the revised guidance.
